TERMS AND CONDITIONS OF PURCHASE

1. INTRODUCTION

In compliance with the Information Society Services and e-Commerce Act no. 34/2002 of 11 July 2002, the Personal Data Protection Act no. 15/1999 of 13 December 1999, Royal Legislative Decree 1/2007 of 16 November 2007, approving the revised text of the General Law for the Defence of Consumers and Users and other legislation in development, AT LEAST, S.A. has drawn up these Terms and Conditions of Purchase to cover the purchase of articles offered in its eShop on their website http://www.deedeeco.com

This document (hereinafter referred to as the "Conditions") constitutes a commercial agreement between the User (hereinafter referred to as the "Customer") and THE DEE DEE MATTRESS CO, S.L. (hereinafter referred to as "THE DEE DEE MATTRESS CO."). These Conditions establish the rights and obligations of the Customer and THE DEE DEE MATTRESS CO, S.L. and determine EXPRESSLY, CLEARLY, COMPREHENSIBLY AND UNEQUIVOCALLY the identity of the owner of the eShop, the characteristics of Dee Dee articles, the prices, methods of payment, purchasing process, guarantees, returns and any other circumstances relating to the purchase of Dee Dee articles.

All Dee Dee articles on sale in the eShop are sold directly by THE DEE DEE MATTRESS CO. S.L., with registered office at P.I. UGALDEGUREN III, Parcela 32-33,48170, Zamudio Spain, holder of Tax Identification Number B-95787081 and of The Dee Dee Mattress Company trademark.

On placing an order, the Customer expressly accepts these Conditions as well as the Data Protection and Privacy Policy and the Legal Notice that can be found on the website . As such, if the Customer does not agree with them, he should not register, visit the website http://www.deedeeco.com or place an order. These Conditions may be amended byThe Dee Dee Mattres Company, SL at any time without prior warning, so the Customer must read them before placing each order.

The Dee Dee Mattres Company, SL offers DeeDee articles in its eShop 24 hours a day, every day of the year. Orders may not be placed by minors.

2. REGISTERING WITH THE ESHOP.

There are two ways to make a purchase; one is as a registered Customer and the other is as a guest (both will be referred to equally as a Customer).

A registered Customer will have to fill in a form providing their personal data, which will allow them to amend their details and keep them up-to-date, manage their purchases, track their orders, consult their purchase history, create one or more wish lists, create a personal shopper profile to get help with their purchases, receive weekly news and participate in promotions, among other options. The data provided with will be incorporated into our database in order to process the order and to facilitate future purchases in our eShop. Once registration is complete, the Customer can access the private area as many times as they wish by entering their personal username and password. A registered Customer can ask to be recognised automatically by the system by clicking the "REMEMBER ME" button, which speeds up the purchase process and enables more direct access to their personal data, since there will be no need for prior identification to access them. Automatic recognition is achieved through the use of cookies, as regulated in the Data Protection and Privacy Policy. If a registered Customer has requested the system to recognise him automatically, The Dee Dee Mattres Company, SL will only request identification when the Customer is connecting to the eShop on the website http://www.deedeeco.com from a different computer than the one usually used or if its temporary Internet files (cache memory and/or cookies) have been deleted.

The email and password are strictly personal and confidential, so the registered Customer will be responsible for keeping them secret and confidential. Consequently, the Customer specifically accepts that, unless proven otherwise, The Dee Dee Mattres Company, SL considers that use of the service and purchases made using his username and password are made by the registered Customer, unless the latter has previously informed The Dee Dee Mattress Company, SL of the loss or theft thereof, by sending an e-mail to shop@deedeeco.com.

The e-mail and password may be freely changed by the registered Customer, using the procedures established by The Dee Dee Mattress Company, SL for that purpose. The old e-mail and password will be cancelled as a means of identification as soon as new ones are generated.

The Dee Dee Mattress Company, SL may block access to and use of the website when it considers this necessary for reasons of security, fraud or breach of obligations. If the registered Customer enters the password incorrectly, a link will appear to start the password recovery process.

A user who makes a purchase as a guest will have no obligation to register as a customer but must provide the personal data necessary to send the shipment and, where applicable, complete the invoice, such as full name, address and telephone number.

Not entering the personal data or entering them incorrectly will block the user's registration as a registered Customer or guest in the eShop. All personal data provided will be subject to our Data Protection and Privacy Policy.

Before completing registration, whether as a registered Customer or guest, the user must accept these conditions of purchase.

3. OBLIGATIONS OF THE CUSTOMER.

The Customer must:

  • Provide The Dee Dee Mattress Company, SL with the correct data necessary for the delivery of the orders.
  • Adopt the necessary security measures, both personal and material, in order to keep his password confidential, immediately notifying The Dee Dee Mattress Company, SL of any loss, theft, burglary or unlawful access, as well as knowledge of said password by third parties.
  • Make payment for the Dee Dee articles purchased through the eShop and all delivery charges, if applicable.
  • The Customer may not make any fraudulent or otherwise false order. The Dee Dee Mattress Company, SL reserves the right to cancel the order and/or notify the relevant authorities in the event that there are reasonable grounds to suspect such fraudulent use.
  • Not to carry out any activity that hinders or interferes with the operation of the eShop.

4. DELIVERY AREA.

Dee Dee articles are delivered exclusively to the countries in which our eShop is available (see countries). In this way, each country has an eShop with its own articles, prices and shipping costs that may vary. The system will automatically recognise the country of access. If the Customer wishes to purchase a product to be delivered to a different country, it will first be necessary to select the country using the corresponding link.

5. PURCHASING PROCEDURE.

The Customer must sign into the eShop in order to purchase DeeDee articles, keeping the following information at hand:

  • Description of the article, reference number, size, characteristics, colours, composition and photograph.
  • Unit price.
  • Delivery costs.
  • Conditions of validity of the offer, where applicable

Once the article has been chosen, the Customer must add it to the basket by clicking on the "ADD TO MY SHOPPING BAG" button, having specified the quantity, size and colour etc. for each article. Once the chosen articles are in the basket, the Customer can access the summary of the selected articles by clicking "SHOPPING BAG" at the top right of the page, where quantities can be changed or items removed, by providing the following information:

  • Dee Dee articles.
  • Description.
  • Amount.
  • Unit Price.
  • Total price of each of the articles purchased.
  • Total purchase price.
  • Delivery charges.

When ready to finalise the purchase, the Customer should click on the "PROCEED TO PURCHASE" button. If the person making the purchase is a registered Customer, he must provide the email address and password he selected himself.

If wanting to make a purchase as a guest, the e-mail and data required for shipping the order must be entered.

The Customer then moves on to the "PAYMENT DETAILS" stage of the order, where as well as entering the payment details, the shipping and invoicing details can also be reviewed and amended. If the Customer has a promotional code or an online voucher, these must be included at this point in order to benefit from the conditions and discounts that can be applied to the purchase.

The Customer will then select the payment method from the options available and must enter the data requested.

In order to confirm the purchase, the Customer must accept the Conditions of Purchase by ticking the corresponding box and clicking on "ACCEPT".

6. ACCEPTANCE OF THE ORDER.

The purchase agreement will not be formalised until the order is accepted by The Dee Dee Mattress Company, SL (even though it may already have been debited from the Customer's account). If the order is rejected and the amount has already been debited from the Customer's account, the amount will be refunded in full within a maximum term of fifteen (15) working days.

After clicking on "CONFIRM AND PAY", the Customer will receive an e-mail with an "Order Confirmation" containing the details corresponding to the order. Failure to receive this message could be due to a temporary network communications problem or to a misspelling of the email address provided. In both cases, the Customer should contact us by email at shop@deedeeco.com.

Receipt of the "Order Confirmation" e-mail does not imply that the order has been accepted, since this is an offer that the Customer makes to The Dee Dee Mattress Company, SL to make a purchase. All orders are subject toThe Dee Dee Mattress Company, SL 'S acceptance, of which the Customer will be informed through an e-mail confirming that the Products are being shipped ("Your order has been shipped"). The transaction between The Dee Dee Mattress Company, SL and the Customer will only be formalised when we send the "Shipping Confirmation". Only the Dee Dee articles described in the Shipping Confirmation shall be covered under this agreement.The Dee Dee Mattress Company, SL may refuse to process orders that do not provide sufficient guarantees of solvency, or that are incomplete or incorrect, or in the event that the Dee Dee articles in question are not available, without this exposing the Customer or third parties to any liability. In any event, The Dee Dee Mattress Company, SL promises to notify the Customer and if any sum has been charged to his account, to refund said amount.

7. CURRENCY, METHOD OF PAYMENT AND APPLICABLE TAXES.

The prices will be shown in euros or pounds sterling. In accordance with current legislation, all purchases made in the eShop shall be subject to all applicable taxes. For security reasons, the Customer may not make purchases in excess of 2,000 euros, nor any order containing over 15 articles within a period of fifteen (15) working days. If the Customer is interested in making purchases in excess of this amount or number of articles, he can contact The Dee Dee Mattress Company, SL customer services via the e-mail hello@deedeeco.com

The Dee Dee Mattress Company, SL makes every effort to ensure that the information contained on its website is true and does not contain errors. If at any time any error of this kind arises, it will be corrected immediately. The Dee Dee Mattress Company, SL reserves the right to amend the prices on the website without prior warning. The price of an article will be that shown at any time in the eShop, except in the case of an obvious error. Although The Dee Dee Mattress Company, SL attempts to ensure that there are no errors in the prices that appear on the site, if an error occurs in the price of an article ordered by the Customer, The Dee Dee Mattress Company, SL will inform the Customer as soon as possible, offering the option of reconfirming the order at the correct price or cancelling it. If The Dee Dee Mattress Company, SL does not manage to contact the Customer, the order will be cancelled and the amounts that have been paid will be fully reimbursed, with no right to compensation.

The Dee Dee Mattress Company, SL will not be obliged to provide the article(s) at the incorrectly listed lower price (even if the Customer has received an order confirmation email) if the error in the price is obvious and unambiguous. In this regard, the reference price shall be the price of said Intropia article in the Intropia store in the country in which the order is placed and/or, if not possible, the listed price in the United Kingdom.

The Dee Dee Mattress Company, SL accepts payment by debit or credit card (Visa, Visa Electron, MasterCard and Maestro, American Express, Diners) and PayPal. In accordance with article 37 of Payment Services Law 16/2009 of 13 November 2009, a commitment to payment made using a bank card is irrevocable. In providing bank card details, the Customer authorises said card to be debited.

All payments are made via a secure payment portal that encrypts card and PAYPAL data. In order to provide maximum security for the payment system, The Dee Dee Mattress Company, SL uses secure payment systems of leading financial institutions in electronic commerce. In this regard, confidential payment information is transmitted directly and encrypted (SSL) to the corresponding financial institution.For payment with Visa and MasterCard cards The Dee Dee Mattress Company, SL has introduced the SEC (Secure Electronic Commerce) service with the international 3D Secure protocol identified by the Verified by Visa and MasterCard SecureCode symbols. The basic principle of Secure Electronic Commerce is to guarantee the security of internet transactions. When making the payment via the secure payment portal, the system will automatically verify that the credit card is activated for Secure Electronic Commerce. It will then connect to the issuing bank, which will request authorisation for the operation using a personal authentication code. The operation will only take place if the bank that issues the credit card confirms the authentication code. Otherwise, the transaction will be rejected.

As an additional measure to the Secure Payment system, and with a view to contributing to the prevention of internet fraud, The Dee Dee Mattress Company, SL reserves the right to verify the personal information supplied by the Customer and adopt the measures it may deem appropriate (including cancelling the order) to ensure that the merchandise in question is delivered in accordance with the details that appear in the order.

8. AVAILABILITY OF ARTICLES.

The Customer accepts that the articles offered by Dee Dee through its eShop are subject to stock availability. If any Dee Dee article is not available once the order has been placed, the Customer shall be notified as soon as possible. At that point, the Customer may modify the order or cancel it. The Dee Dee Mattres Company, SL reserves the right to modify the articles on offer in the eShop at any point without prior notice

9. SHIPMENT AND DELIVERY OF ARTICLES.

The Articles are sold and delivered in the countries listed on the website (see countries). The country of delivery must always be the same as the country in which the eShop used by the Customer to make the order is located.

The Dee Dee Mattress Company, SL. offers two shipping methods (Express and Standard) and different delivery options are available depending on the destination country, as detailed below:

  • Home delivery: Articles are shipped using a courier company chosen by The Dee Dee Mattress Company, SL. Articles will be sent to the delivery address that the Customer has indicated to us when completing the order.

    The Customer's order will be delivered within the period of time indicated below, depending on the shipping method. The Dee Dee Mattress Company, SL will make every effort to ensure that the service is provided in the shortest time possible (see delivery charges and conditions).

    Once the order leaves The Dee Dee Mattress Company, SL's warehouses, an email will be sent to the Customer to confirm that the order has been dispatched.

    Registered Customers may track their orders in the "MY ACCOUNT" area in the eShop by clicking "MY ORDERS" and then the "ORDER DETAILS" button and, if the purchase was made as a guest, the order can be viewed from within "MY ORDERS".

    For security reasons, The Dee Dee Mattress Company, SL will not ship any order to a PO Box number, nor will it accept any order where it is not possible to identify the recipient and the address.

    Responsibility for the DeeDee articles will be transferred to the Customer at the moment the order is delivered.

    In the event that the order cannot be delivered because the Customer is not present, the package will be returned to the central warehouse and it will be understood that the Customer rejects the content and will not be entitled to demand a refund on the order.The Dee Dee Mattress Company, SL may in good faith reimburse the customer for the order once it has been returned to our warehouses, deducting the shipment and return costs caused by non-receipt of the shipment by the Customer from the reimbursement. If the Customer wants to receive the order again, the order must be placed again.

Note: delivery times refer to working days (excluding weekends) from the moment the order leaves our warehouses. The Customer's order will be delivered within the delivery time frame stipulated, from the date the order leaves the warehouses.

Once the order leaves The Dee Dee Mattress Company, SL warehouses, an email will be sent to the Customer to confirm that the order has been dispatched.

The orders will be shipped to the delivery address the Customer provided when placing the order, so it is important that the Customer pays close attention when placing the order as it will not be possible to amend the delivery address details afterwards.The Dee Dee Mattress Company, SL will not be responsible if the delivery address is incorrect or incomplete.

For security reasons, The Dee Dee Mattress Company, SL will not ship any order to a PO Box number, nor will it accept any order where it is not possible to identify the recipient and the address.

Responsibility for the Dee Dee articles will be transferred to the Customer at the moment the order is delivered.

10. PROBLEMS WITH DELIVERY.

If an order is not received within ten (10) working days of the date of receipt of the dispatch notification, the Customer undertakes to notify The Dee Dee Mattress Company, SL of this fact.

Upon delivery of the order, the Customer should check that everything is as requested. If there is any discrepancy or problem with the order, the Customer should notify The Dee Dee mattress Company, SL via email at shop@deedeeco.com within a maximum of 24 hours of receipt. Said email should indicate the Customer's personal details and the order number, as well as provide a description of the discrepancy or problem. The Dee Dee Mattress Company, SL will contact the Customer as soon as possible to resolve the matter.

11. DISCOUNT CODES.

The Dee Dee Mattress Company, SL may offer discount codes to Customers; these codes may only be applied to purchases made through the account to which the discount code was offered and registered.

12. CANCELLATION, EXCHANGE AND RETURN POLICY.

  • RIGHT TO CANCEL THE ORDER. RIGHT TO WITHDRAWAL..

    Our Customers may, within a term of 14 calendar days of receipt of the order, cancel the order by sending an e-mail to shop@deedeeco.com notifying us of the cancellation, with the following subject line: Notice of order cancellation (quoting the number). The Customer may use the withdrawal template provided as an appendix to these conditions, though it is not obligatory to use this and the contract may be cancelled via an unequivocal statement (for example, a letter sent by post, fax or e-mail).

    After receiving the e-mail cancelling the order, The Dee Dee Mattress Company, SL will send to the Customer an e-mail with the cancellation number. The Customer should write this cancellation number on the delivery note accompanying the Dee Dee articles received. The right to cancellation will be dependent on the Dee Dee articles being returned in the same conditions in which the Customer received them, along with their complete and original packaging, labels and any other related accessories.

    The only address where the DeeDee articles will be received is The Dee Dee Mattres Company SL Headquarters , P.I. Ugaldeguren III, parcela 32-33, 48170 Zamudio, Bizkaia, Spain.

    The Dee Dee Mattress Company, SL recommends that the Customer use a secure method by which to send the cancelled order which may be tracked, as the Customer shall be liable for any damages to the Dee Dee articles until they are received by the The Dee Dee Mattress Company, SL warehouse. The Customer will assume the expenses of returning the cancelled order. The Customer is also advised to keep proof of shipment of the cancelled order, should any eventuality arise.

    After the Customer's cancelled order is received by The Dee Dee Mattress Company, SL's warehouse, we will determine if the Dee Dee articles that we have received are in the same condition they were in when they were shipped. Any Dee Dee articles that have been returned damaged, incomplete, ruined, used or dirty will not be reimbursed and will be sent back as Collect on Delivery or the articles will be left at the disposal of the Customer in the warehouse for collection within a maximum of sixty (60) calendar days. After this term, it will be understood that the Customer rejects the article and will not be able to claim liability from The Dee Dee Mattress Company, SL. During the time that the wrongly returned articles are at The Dee Dee Mattres Company, SL 'S premises,The Dee Dee Mattress Company, SL shall have no responsibility for their safekeeping or storage.

    In the event of cancellation of the order we will return all the payments received to the customer, including the shipping costs (with the exception of the additional expenses resulting from the Customer selecting a different method of delivery than the least expensive standard delivery we offer) with no undue delay and, in any case, no longer than 14 calendar days from the date on which we are advised of the withdrawal from the contract.

    If the customer only returned part of the order, it is understood that the order is not being cancelled but that the Customer wishes to return part of it, therefore The Dee Dee Mattress Company, SL will only reimburse the amount of the returned products, not including shipping costs.

    We will refund said amount using the same means of payment used by the Customer for the initial transaction. The Customer will not incur any cost as a result of the refund, except the costs of return that will be his responsibility, therefore, the Customer is responsible for sending the package to our warehouses. Notwithstanding the above, we may withhold reimbursement until we have received the goods or until the Customer has presented evidence of the return of said goods, depending on which condition is fulfilled first.

    The Customer must return the products to us within a maximum term of 14 calendar days of the date on which we are notified of the decision to cancel the Contract.

  • CHANGES AND RETURNS

    In addition to the regulations governing distance selling, The Dee Dee Mattress Company, SL allows the Customer to return or exchange (substitute for another article) within FIFTEEN (15) calendar days of the date of receipt of the order except as provided for in this Clause.

    For both exchange and return, the following requirements must be met:

    a) The articles must be in perfect condition, in their original packaging and with all labels, otherwise they cannot be exchanged or returned.

    b) Together with the product that is being returned, the Customer must send the delivery note that was included in the box, writing the return number that will have been issued by the system when generating the return.

    In order to process an exchange or return, the customer must follow the following procedure:

    • Step 1: Registered customers must enter their e-mail and password on the website and go to MY ACCOUNT; customers who entered as a guest must go to MY ORDERS and look for the order using their e-mail and the number of the order they want to exchange or return. In both cases, the Customer must then select ORDER DETAILS and then "EXCHANGE OR RETURN".

    • Step 2: Customers must then choose the article(s) that they wish to return or exchange and click on the selected option. If this is "Exchange", select a reason for the exchange and also the new size and/or colour.

    • Step 3: For a "Return", choose a reimbursement method (store credit or refund to the same payment method used when the order was placed). Then choose the delivery method available in your country for carrying out the exchange or return. The Customer can choose between returning using our collection service (free for exchanges and returns to be refunded as store credit; with a charge for returns to be refunded to a card) or returning it to our warehouses at the Customer's expense.

    • Step 4: Select CONFIRM EXCHANGE/RETURN. The system will generate a return and/or exchange number to identify the process.

    • Step 5: Write the assigned return number on the delivery note that came with the order or failing that, on the outside of the original box the Customer received and place the articles in the box.

    • Step 6: If the Customer has chosen to use our collection service for the return, a Courier will come to the address provided by the Customer within 24/48 working hours.

    Processing the return or exchange does not represent the definitive acceptance of the article(s), since this is subject to verification of the good state of said article(s) together with any related accessories.

    When the same method of payment with which the order was made is selected for the return, the amount of the return will be paid in accordance with the conditions of the Customer's bank. Normally, in the case of payment by credit card, the amount is credited at the time of settlement; however, in the case of payment by debit card, the refund will be made within thirty (30) working days.

    Any articles that are returned in a damaged, incomplete, ruined, used or dirty state for reasons attributable to the Customer will not be refunded and shall be returned to the Customer as Collect on Delivery or the article will be made available for the Customer to collect within a maximum period of sixty (60) days. After this term, it will be understood that the Customer rejects the article and will not be able to claim liability from The Dee Dee Mattress Company, SL. During the time that the wrongly returned articles are at The Dee Dee Mattres Company, SL 'S premises, The Dee Dee Mattres Company, SL shall have no responsibility for their safekeeping or storage.

    The Dee Dee Mattres Company, SL reserves the right to reject any return that does not meet the aforementioned conditions.

  • CHANGES AND RETURNS

    In addition to the regulations governing distance selling, The Dee Dee Mattress Company, SL allows the Customer to return or exchange (substitute for another article) within FIFTEEN (15) calendar days of the date of receipt of the order except as provided for in this Clause.

    For both exchange and return, the following requirements must be met:

    a) The articles must be in perfect condition, in their original packaging and with all labels, otherwise they cannot be exchanged or returned.

    b) Together with the product that is being returned, the Customer must send the delivery note that was included in the box, writing the return number that will have been issued by the system when generating the return.

    In order to process an exchange or return, the customer must follow the following procedure:

    • Step 1: Registered customers must enter their e-mail and password on the website and go to MY ACCOUNT; customers who entered as a guest must go to MY ORDERS and look for the order using their e-mail and the number of the order they want to exchange or return. In both cases, the Customer must then select ORDER DETAILS and then "EXCHANGE OR RETURN".

    • Step 2: Customers must then choose the article(s) that they wish to return or exchange and click on the selected option. If this is "Exchange", select a reason for the exchange and also the new size and/or colour.

    • Step 3: For a "Return", choose a reimbursement method (store credit or refund to the same payment method used when the order was placed). Then choose the delivery method available in your country for carrying out the exchange or return. The Customer can choose between returning using our collection service (free for exchanges and returns to be refunded as store credit; with a charge for returns to be refunded to a card) or returning it to our warehouses at the Customer's expense.

    • Step 4: Select CONFIRM EXCHANGE/RETURN. The system will generate a return and/or exchange number to identify the process.

    • Step 5: Write the assigned return number on the delivery note that came with the order or failing that, on the outside of the original box the Customer received and place the articles in the box.

    • Step 6: If the Customer has chosen to use our collection service for the return, a Courier will come to the address provided by the Customer within 24/48 working hours.

    Processing the return or exchange does not represent the definitive acceptance of the article(s), since this is subject to verification of the good state of said article(s) together with any related accessories.

    When the same method of payment with which the order was made is selected for the return, the amount of the return will be paid in accordance with the conditions of the Customer's bank. Normally, in the case of payment by credit card, the amount is credited at the time of settlement; however, in the case of payment by debit card, the refund will be made within thirty (30) working days.

    Any articles that are returned in a damaged, incomplete, ruined, used or dirty state for reasons attributable to the Customer will not be refunded and shall be returned to the Customer as Collect on Delivery or the article will be made available for the Customer to collect within a maximum period of sixty (60) days. After this term, it will be understood that the Customer rejects the article and will not be able to claim liability from The Dee Dee Mattress Company, SL. During the time that the wrongly returned articles are at The Dee Dee Mattres Company, SL 'S premises, The Dee Dee Mattres Company, SL shall have no responsibility for their safekeeping or storage.

    The Dee Dee Mattres Company, SL reserves the right to reject any return that does not meet the aforementioned conditions.

  • RETURNS DUE TO ERRORS IN THE ORDER. FAULTY ARTICLES.

    If the Customer receives an order with an error in the size, colour or model, The Dee Dee Mattress Company, SL should be contacted immediately by email at shop@deedeeco.com stating the error and providing all relevant personal details. Once the matter has been analysed, we shall contact the Customer in order to resolve the supposed error as quickly as possible.

    In the event that the article is faulty or shows signs of imperfection, the Customer should contact The Dee Dee Mattress Company, SL as soon as possible by email at shop@deedeeco.com. Once The Dee Dee Mattress Company, SL has received the returned goods, the article(s) in question will be thoroughly examined and an email shall be sent to the Customer within a maximum of five (5) working days confirming the refund or replacement (if applicable). The article will be refunded or replaced as quickly as possible and, in any case, within thirty (30) calendar days following the date on which an e-mail is sent confirming the refund or replacement of the non-compliant article, in which case, The Dee Dee Mattress Company, SL will assume the transport cost of the return and delivery of the replaced article. In the event that the article cannot be substituted for another of identical characteristics, the Customer shall be refunded in full. Refunds shall be made via the same payment method used to make the original purchase.

13. LIABILITY AND EXEMPTION OF LIABILITY

The Dee Dee Mattress Company, SL's liability in respect of any article acquired through the www.deedeeco.com domain shall be strictly limited to the purchase price of said article. Notwithstanding the provisions of the above paragraph and to the extent permitted by law, except where these Terms & Conditions state otherwise, The Dee Dee Mattress Company, SL accepts no liability for any indirect damage deriving secondarily from any principal loss or damage, arising in any manner and including any such loss or damage caused by tort or civil wrong (including negligence), breach of contract etc., even in such circumstances where this may have been foreseeable.

All descriptions of articles, information and materials which feature on this website are provided "as is", with no express or implicit guarantees, or any which might be inferred by any other means.

The provisions of this paragraph do not affect the Customer's legal rights as a consumer, nor the right to withdraw from this contract. Claim forms are available for the customer. The form can be requested from our customer care department shop@deedeeco.com

In the same way, the Customer is reminded that the acquired products have a legal guarantee of two years from the date of delivery. Defects caused by negligence in use and/or treatment and/or normal wear and tear are not covered. In order to make use of the guarantee within the established legal term of two years from delivery of the product, it is essential that proof of purchase is presented.

14. EVENTS FALLING OUTSIDE AT LEAST'S CONTROL.

The Dee Dee Mattress Company, SL shall not be deemed liable for any breach of or delay in compliance with any of the obligations established in this agreement which may be attributable to events out of its control (Force Majeure).

Force Majeure shall include any act, event, failure to perform, omission or accident outside reasonable control and will, in particular, include (but not be limited to) the following:

Strikes, lockouts, revolt, invasion or terrorist attack.

Fire, explosion, storm, flood, earthquake, collapse, epidemic or any other natural disaster.

Impossibility of using trains, boats, aircraft, motor transport or other means of transport, whether public or private.

Impossibility of using private or public telecommunications systems.

Acts, decrees, legislation, regulations or restrictions imposed by other governments.

15. PROTECTION OF PERSONAL DATA. PRIVACY AND CONFIDENTIALITY POLICY.

The Dee Dee Mattress Company, SL hereby guarantees that all personal data shall be handled in compliance with the Spanish Personal Data Protection Act no. 15/1999 of 13 December 1999 (LOPD), Royal Decree no. 1720/2007 of 21 December 2007, approving the Implementing Regulation of the Personal Data Protection Act no. 15/1999 (RLOPD), and legislation regarding information society and e-commerce services (LSSICE). To this end, The Dee Dee Mattress Company, SL has adopted the appropriate technical and organisational security measures in its facilities, systems and files.

In order to purchase Dee Dee articles, Customers will need to provide personal data, all of which must be true, exact, up-to-date and complete. By purchasing and accepting the terms and conditions of purchase, the Customer is deemed to be legally informed and to allow The Dee Dee Mattress Company, SL to store and handle the personal data provided at the time of purchase, those derived from the use of the service (data collected from the purchases), as well as data from the IT processes for the purpose of providing the service requested by the Customer and of making the Customer a participant in the commercial plan, for which data segmentations, market studies and profiles may be drawn up, whether or not they are derived from the analysis of the Customer's purchasing habits; such data processing shall enable discounts, promotions and any other special offers to be applied to the Customer who shall also be able to receive promotional correspondence, the sending of which by email is expressly authorised when registering for the service.

As data security and Customer privacy protection and guarantee are essential regulations at The Dee Dee Mattress Company, SL, it is advisable that the Customer read our Data Protection and Privacy Policy, applicable to all Customer data, which is described below.

16. PARTIAL ANNULMENT.

If any of these general conditions is declared to be null and void, invalid or inapplicable, this shall not affect the validity or applicability of the other conditions which shall continue to be binding between the parties.

Should any of the parties waive their right to demand compliance at a given time of any of the general conditions stipulated herein, this shall not imply that compliance with the other condition or conditions shall also be waived, nor shall it create an acquired right for the other party.

17. NOTICES.

Part of the information or communications that are sent to the Customer shall be in writing and electronic. The customer, therefore, hereby grants consent to use such a method of communication. This condition shall not affect the Customer's rights recognised by the applicable laws. Such notices shall be understood to have been made correctly and duly received at the moment they appear on the website, 24 hours after sending an e-mail or three (3) working days from the post-marked date of any letter.

These terms and conditions will be governed by Spanish law. For the resolution of any doubt, discrepancy or divergence that could arise in the fulfilment and interpretation of this contract, the parties submit to the Courts and Tribunals of Madrid (Spain).
